Requested extension

This case is still in the appeals process.  Rick Young has requested an extension until February 28, 2013 to file his final brief in the appeals process.  Usually, after the last brief is filed it takes the appellate court three to six months to issue their decision.  Everything regarding restitution is on hold until the appellate court makes their decision.

Appeal and liquidation

This is an update on the Global One case.  The properties are still in the process of being liquidated.  Unfortunately, since Rick Young filed an appeal, proceeds are not able to be released until the appeal is finalized.  The appeals process is sometimes lengthy.  Currently, the briefs are due to be filed by November 21, 2012.  Once the last brief is filed, it normally takes about six months to get the decision from the appellate court.

Rick Young not eligible for parole

RICK YOUNG is currently incarcerated at FCI Florence and is scheduled for release on January 7, 2033.  The inmate is not eligible for parole.

Mont. man gets 25 years prison for investment scam By AP | December 14, 2011 RENO, Nev. (AP)

A Montana man convicted of running an investment scam on the Internet was sentenced Tuesday to 25 years in federal prison and ordered to pay $13.2 million in restitution to more than 1,400 investors. U.S. District Judge Larry Hicks in Reno told Rick Young, 52, of Lewistown, that the fraud carried out by his Nevada-based Global One Group from 2006 to 2007 was "incredibly repulsive."

Many of the victims, the judge said, were vulnerable, "middle-class working people taking money out of accounts, trading out of their 401(k) plans, their pension plans, even off of their credit cards." "Frankly, it was nothing more than a type of Ponzi scheme, but it was incredibly sophisticated," he said. Among other things, prosecutors said Young and his partner used the money for their own gain in 2006 and 2007 partly by falsely marketing the Global One as a licensed securities broker.

A federal jury in March convicted Young of one count of conspiracy to commit mail and wire fraud, two counts of wire fraud, three counts of money laundering and one count of securities fraud.

Today the Judge signed an order continuing Rick Young's sentencing to December 13, 2011 at 9:00 am. Due to an injury to one of the government attorneys, we asked the Judge to continue the sentencing. We will also be asking to move William Willard's sentencing to December 13th or 14th. The official notification about the change will be going out tomorrow.

Defendant Young's motion for a new trial was denied and he will be sentenced by the Court on October 17 for the guilty verdicts on the following counts: Count 1 (Conspiracy to Commit Wire Fraud); Counts 2 and 6 (Wire Fraud); Count 11 (Money Laundering); and Count 13 (Securities Fraud). Based on the guilty verdicts, the defendant faces a maximum sentence of 80 years imprisonment and a $2 million fine.
