Defendant Young's motion for a new trial was denied and he will be sentenced by the Court on October 17 for the guilty verdicts on the following counts: Count 1 (Conspiracy to Commit Wire Fraud); Counts 2 and 6 (Wire Fraud); Count 11 (Money Laundering); and Count 13 (Securities Fraud). Based on the guilty verdicts, the defendant faces a maximum sentence of 80 years imprisonment and a $2 million fine. The Court, however, has complete discretion to sentence defendant Young to any range of punishment from no punishment up to the maximum , based on its consideration of, among other things, the offense characteristics, the defendant's history, and the advisory federal sentencing guidelines.

At the hearing on July 21, 2011, the judge agreed to continue the sentencing hearing for Rick Young. The Judge heard oral argument on defendant Young's motions and will make his ruling in a couple of weeks. After the Judge makes his ruling, he will set a new date for defendant Young's sentencing.

Yesterday, there was a court hearing regarding the release of Mr. Young pending sentencing and appeal. The court denied the defendant's motion, he will stay in custody. The defendant asked for a continuance of his sentencing date, the Judge granted that motion. The new sentencing date for Mr. Young is July 27, 2011 at 10:00 a.m.

Rick Young and William Willard were charged with Conspiracy to Commit Wire Fraud, Wire Fraud, Securities Fraud, and Money Transactions in Property Derived from Specified Unlawful Activity on December 3, 2008. On February 25, 2011, William Willard pled guilty to Conspiracy to Commit Wire Fraud and is scheduled to be sentenced on July 25, 2011 at 1:30 p.m. Rick Young was found guilty by a jury on March 30, 2011 of Conspiracy to Commit Wire Fraud, Wire Fraud, Monetary Transactions in Property Derived from Specified Unlawful Activity, and Securities Fraud, he is scheduled to be sentenced on June 30, 2011 at 10:00 a.m.
