A Montana man convicted of running an investment scam on the Internet was sentenced Tuesday to 25 years in federal prison and ordered to pay $13.2 million in restitution to more than 1,400 investors.U.S. District Judge Larry Hicks in Reno told Rick Young, 52, of Lewistown, that the fraud carried out by his Nevada-based Global One Group from 2006 to 2007 was "incredibly repulsive."

Many of the victims, the judge said, were vulnerable, "middle-class working people taking money out of accounts, trading out of their 401(k) plans, their pension plans, even off of their credit cards.""Frankly, it was nothing more than a type of Ponzi scheme, but it was incredibly sophisticated," he said.Among other things, prosecutors said Young and his partner used the money for their own gain in 2006 and 2007 partly by falsely marketing the Global One as a licensed securities broker.

A federal jury in March convicted Young of one count of conspiracy to commit mail and wire fraud, two counts of wire fraud, three counts of money laundering and one count of securities fraud.

2 Montana men convicted in Nevada on fraud

Two Montana men have been convicted in Nevada on federal conspiracy and fraud charges for a scheme in which they promised big returns in the foreign currency exchange market to hundreds of investors.

A jury in U.S. District Court in Reno on Wednesday convicted Rick Young of Lewistown on seven counts, including conspiracy, wire fraud, securities fraud and engaging in money transactions in property derived from illegal activity, court records said. U.S. District Judge Larry R. Hicks ordered Young into custody and set sentencing for June 30.

The jury continued deliberations on forfeiture allegations.

The government is seeking the forfeiture of approximately $493,849 in a bank account for Global One Group LLC, which was owned by the defendants, Superior Automotive Repair & Towing and Superior Towing, both Lewistown companies managed by Maelee Enterprises, a company owned by Young, and nine properties in Lewistown and Bozeman.

In February, co-defendant William Willard of Bozeman pleaded guilty to one conspiracy count and is to be sentenced on June 6, court records said.

The conspiracy count carries a maximum sentence of 30 years in prison and a $1 million fine.

Young and Willard, along with their Nevada-based companies, Global One Group LLC; Maelee Enterprises Inc.; and Badie Inc., were indicted in December 2008.

The U.S. Attorney’s Office said the men persuaded more than 700 victims to invest hundreds of thousands of dollars into Global One with the expectation that they would earn high rates of return. Young and Willard made false representations to investors and charged investors a $500 annual membership fee for access to Global One’s website and to participate in conference calls and web-based seminars.

Young and Willard represented in the calls and seminars that Young had made 800 successful trades in a year on the foreign exchange market without one loss, that Global One investors could earn a substantial rate of return on their investments and that Global One had an automated software trading program that they said could automatically execute successful trades in the market.

The indictment said Young’s trading record was misleading and accounted only for profitable trades that had been closed and that Global One did not have the software it advertised. Young and Willard used the money from investors for their own personal use through bank transfers from Global One to the accounts of Maelee Enterprises and Badie, companies owned respectively by Young and Willard, the government said.

Young and Willard received about $900,000 from investors through their false claims from April 2006 until October 2007, the indictment said.

Two men have been charged with federal conspiracy, fraud and money laundering crimes after they convinced over 700 victims to invest hundreds of thousands of dollars in their Nevada-based company with the expectation that they would earn high rates of return in the foreign currency exchange market, announced Greg Brower, United States Attorney for the District of Nevada.

Richard Young, 49, of Lewistown, Montana, and William Willard, 65, of Bozeman, Montana, as well as the Nevada-based companies they operated, Global One Group, LLC (Global One), Maelee Enterprises, Inc., and Badie, Inc., are charged in a December 3, 2008 Indictment with one count of conspiracy to commit mail and wire fraud, five counts of mail fraud, five counts of wire fraud, 11 counts of money laundering, 11 counts of engaging in money transactions with property derived from criminal activity, and criminal forfeiture. The Indictment was sealed until December 30, 2008, to allow law enforcement officials time to serve the defendants with summons to appear in court to answer the charges.

“Individuals should be particularly cautious of promises of unusually high rates of return on investments,” said U.S. Attorney Brower. “Offers that sound too good to be true could actually be part of a fraudulent scheme devised to steal your money.”

According to the allegations in the indictment, Young and Willard made false representations to enrich themselves with hundreds of thousands of dollars they received from investors in the United States and in foreign countries. Young and Willard told investors that they provided an educational opportunity regarding trading techniques on the foreign currency exchange market. Young and Willard charged investors a $500 annual membership fee to access Global One’s website and to participate in Global One’s conference calls and web-based seminars (“webinars”). In these calls and webinars, Young and Willard represented that Young had made 8000 successful trades in a year on the foreign exchange market without one loss, that Global One investors could earn a substantial rate of return on their investments, and that Global One had an automated software trading program, called “Global Trac,” which they said had been tested and improved upon and had the ability to automatically execute successful trades on the foreign exchange market.

Global One allegedly received money from some investors in the form of loans and instructed investors to open accounts with brokers approved by Global One. In addition, the defendants obtained powers of attorney from the investors which gave the defendants rights to make trades on the investors’ behalf. Young and Willard told investors that the services Global One provided were governed by the regulations of the foreign currency exchange market; however, Global was not a licensed broker in that market and therefore was not subject to its regulations or the regulations of the Commodity Futures Trading Commission or the National Futures Association.

The indictment alleges that Young’s trading record was misleading in that it accounted only for profitable trades that had been closed. Moreover, it is alleged that Global One did not have the “Global Trac” software it advertised on its conference calls and in its “webinars.” In addition, Young and Willard did not intend to fulfill the substantial rate of return on loans provided to them by their investors, as Young and Willard used the monies they received from the investors primarily for their own personal use by transferring the monies from the Global One bank accounts in Reno and Las Vegas to the bank accounts of Maelee Enterprises, Inc.,and Badie, Inc., companies owned respectively by Young and Willard. The indictment alleges that between April 2006 and October 2007, Young and Willard received approximately $900,000 from investors as a result of their false representations.

According to the indictment, from about January 2006 to February 2007, Global One’s offices were located at 5190 Neil Road, Suite 430, in Reno, Nevada, and that, in February 2007, Global One moved its offices to 1850 East Sahara Avenue, Suite 207, in Las Vegas, Nevada. Young is listed in corporate records as the founder, President, Chief Executive Officer, and Manager of Global One. Willard is a co-founder and Member of Global One.

The defendants are scheduled to appear before U.S. Magistrate Judge Valerie P. Cooke in Reno on January 22, 2009, at 3:00 p.m. for an initial appearance and arraignment. If convicted, they face up to 30 years in prison and a $1,000,000 fine on the conspiracy count and on each mail fraud and wire fraud count, up to 20 years in prison and a $500,000 fine on each money laundering count, and up to 10 years in prison and a $250,000 fine on each count of engaging in money transactions in property derived from unlawful activity.

The investigation is being conducted by the IRS Criminal Investigation and the FBI. The case is being prosecuted by Assistant United States Attorney James E. Keller.

I am one of the sad lenders who is still waiting for their loan to be paid back. I have no feeling of confidence in their ability to do this. Global one does have good charts and Rick knows how to trade pretty well. Unfortunately, they are poor money managers. For instance, they warned us of the FCM scams, then proceeded time after time to place our funds in one account after another. Global one then acts surprised when the FCM goes out of business, rips the money off, etc. What? Rick and Global one do not seem to take responsibility for the fall of the "Loan" program the promised the "mother of all returns." How many times did we hear Bill say "we are there!" only to be disappointed time and time again. Now Bill is trying to raise $500,000 for his Endwert Group? What? That's right. He has the guts to send emails to Global One members to solicit more funds from us. What? Do we really want to loose more money? As far as I can see, Global one is broke, but for the money dues that a hand full of "non lenders" pay to listen to Rick "Call the shots" on where the market is going. I believe in hindsight, that Global One does not have the street smarts to play in this Trillion dollar industry. Why didn't Rick just get his Series 3 license? My brother is involved in an IB that started after Global One. They have millions that they manage with a couple of auto trading programs. Their most recent program is a correlated trading program. It paid for his snow mobiles in 3 weeks of trading! Now I ask, where is the money Global one was loaned? How many FCM's have they been through? Whose fault is it anyway? Who selected the FCM's that ripped us off? It wasn't me or any other "lender." It was Rick and or Global one staff that fled from one FCM to another. Global One can talk and blame every FCM out there for their losses. Bottom line: they have $175,000 of money that belongs to me and 4 other people that were foolish enough to believe in them. I have better odds of winning a million dollar lottery than getting my money back. Come on Rick, prove me wrong!!
